Max van Manen offers an extensive exploration of phenomenological traditions and methods for the human sciences. It is his first comprehensive statement of phenomenological thought and research in over a decade. Phenomenology of practice refers to the meaning and practice of phenomenology in professional contexts such as psychology, education, and health care, as well as to the practice of phenomenological methods in contexts of everyday living. Van Manen presents a detailed description of key phenomenological ideas as they have (...) evolved over the past century; he then thoughtfully works through the methodological issues of phenomenological reflection, empirical methods, and writing that a phenomenology of practice offers to the researcher. BackgroundFor many decades, the debate on children’s competence to give informed consent in medical settings concentrated on ethical and legal aspects, with little empirical underpinnings. Recently, data from empirical research became available to advance the discussion. It was shown that children’s competence to consent to clinical research could be accurately assessed by the modified MacArthur Competence Assessment Tool for Clinical Research. Age limits for children to be deemed competent to decide on research participation have been studied: generally children of 11.2 (...) years and above were decision-making competent, while children of 9.6 years and younger were not. Age was pointed out to be the key determining factor in children’s competence. In this article we reflect on policy implications of these findings, considering legal, ethical, developmental and clinical perspectives.DiscussionAlthough assessment of children’s competence has a normative character, ethics, law and clinical practice can benefit from research data. The findings may help to do justice to the capacities children possess and challenges they may face when deciding about treatment and research options. We discuss advantages and drawbacks of standardized competence assessment in children on a case-by-case basis compared to application of a fixed age limit, and conclude that a selective implementation of case-by-case competence assessment in specific populations is preferable. We recommend the implementation of age limits based on empirical evidence. Furthermore, we elaborate on a suitable model for informed consent involving children and parents that would do justice to developmental aspects of children and the specific characteristics of the parent-child dyad.SummaryPrevious research outcomes showed that children’s medical decision-making capacities could be operationalized into a standardized assessment instrument. Recommendations for policies include a dual consent procedure, including both child as well as parents, for children from the age of 12 until they reach majority. For children between 10 and 12 years of age, and in case of children older than 12 years in special research populations of mentally compromised patients, we suggest a case-by-case assessment of children’s competence to consent. Since such a dual consent procedure is fundamentally different from a procedure of parental permission and child assent, and would imply a considerable shift regarding some current legislations, practical implications are elaborated. During the last two decades there has been an enormous development in treatment possibilities in the field of neonatology, particularly for (extremely) premature infants. Although there are cross-cultural differences in treatment strategy, an overview of the literature suggests that every country is confronted with moral dilemmas in this area. These concern decisions to initiate or withhold treatment directly at birth and, later on, decisions to withdraw treatment with the possible consequence that the child will die. Given that the neonate cannot (...) express his or her own will, who will decide? And on the basis of what information, values and norms? We explored some of these issues in daily practice by interviewing a small sample of health care practitioners in a Dutch university Neonatal Intensive Care Unit (NICU). It turned out that experiencing moral dilemmas is part of their daily functioning. Nurses underline the suffering of the newborn, whereas physicians stress uncertainty in treatment outcome. To make the best of it, nurses focus on their caring task, whereas physicians hope that future follow-up research will lead to more predictable outcomes. As for their own offspring, part of these professionals would hesitate to bring their own extremely premature newborn to a NICU. For the most oppressing dilemma reported – terminating an already initiated treatment – we propose the concept of ‘evidence shift’ to clarify the ambiguous position of uncertainty in decision making. In the present article we argue that emotional interactions are not appropriately captured in present emotion research and theorizing. Emotional stimuli or antecedents are dynamic and change over time because they often interact and have a specific relationship with the subject. Earlier emotional interactions may, for example, intensify later emotional reactions to a specific person, or our anger reactions towards powerful or powerless others may differ considerably. Thus, we suggest that such social factors not only affect the intensity, but also (...) the nature of emotional experiences and expressions, and specifically the nature of the social movement (e.g., moving towards, away, or against). We discuss different processes that are implicated in the relation between the social environment and our emotions, describe how emotional expressions shape social behavior, and provide suggestions for incorporating the social dimension of emotion in future research. Over 30 million people worldwide have taken a commercial at-home DNA test, because they were interested in their genetic ancestry, disease predisposition or inherited traits. Yet, these consumer DNA data are also increasingly used for a very different purpose: to identify suspects in criminal investigations. By matching a suspect’s DNA with DNA from a suspect’s distant relatives who have taken a commercial at-home DNA test, law enforcement can zero in on a perpetrator. Such forensic use of consumer DNA data has (...) been performed in over 200 criminal investigations. However, this practice of so-called investigative genetic genealogy raises ethical concerns. In this paper, we aim to broaden the bioethical analysis on IGG by showing the limitations of an individual-based model. We discuss two concerns central in the debate: privacy and informed consent. However, we argue that IGG raises pressing ethical concerns that extend beyond these individual-focused issues. The very nature of the genetic information entails that relatives may also be affected by the individual customer’s choices. In this respect, we explore to what extent the ethical approach in the biomedical genetic context on consent and consequences for relatives can be helpful for the debate on IGG. We argue that an individual-based model has significant limitations in an IGG context. The ethical debate is further complicated by the international, transgenerational and commercial nature of IGG. We conclude that IGG should not only be approached as an individual but also—and perhaps primarily—as a collective issue. There are no data in this work. (shrink)

The notion that emotional expressions regulate social life by providing information is gaining popularity. Prior research on the effects of emotional expressions on observers’ inferential processes has focused mostly on inferences regarding the personality traits of the expresser, such as dominance and affiliation. We extend this line of research by exploring the possibility that emotional expressions shape observers’ construal of social situations. Across three vignette studies, an interaction partner's expressions of anger, compared to expressions of happiness or disappointment, led observers (...) to construe hypothetical situations as less cooperative, both in dyads and groups. These effects occurred even when factual information regarding the cooperativeness or competitiveness of the situation was provided, attesting to the power of emotional expressions in shaping the construal of social situations. Results are discussed in relation to appraisal theory, reverse appraisals, emotions as social information theory, and the emergence of cooperation in groups and cultures. (shrink)

Millions of human biological samples are stored worldwide for medical research or treatment purposes. These biospecimens are of enormous potential value to law enforcement as DNA profiles can be obtained from these samples. However, forensic use of such biospecimens raises a number of ethical questions. This article aims to explore ethical issues of using human bodily material in medical biobanks for crime investigation and prosecution purposes. Concerns about confidentiality, trust, autonomy and justice will be discussed. We explore how to balance (...) these concerns against the importance of crime solving. Relevant case examples of forensic use of medical biobanks show that requests by law enforcement to access biobanks are handled in disparate ways. We identify some core ethical issues and conclude that further research on these issues is needed to provide ethical guidance. (shrink)

ABSTRACTDynamic changes in emotional expressions are a valuable source of information in social interactions. As the expressive behaviour of a person changes, the inferences drawn from the behaviour may also change. Here, we test the possibility that dynamic changes in emotional expressions affect person perception in terms of stable trait attributions. Across three experiments, we examined perceivers’ inferences about others’ personality traits from changing emotional expressions. Expressions changed from one emotion to another emotion, allowing us to disentangle potential primacy, recency, (...) and averaging effects. Drawing on three influential models of person perception, we examined perceptions of dominance and affiliation, competence and warmth, and dominance and trustworthiness. Previous research on the interpersonal effects of emotions in negotiation suggested that bargainers obtain higher outcomes expressing anger, when it is not directed against the counterpart as a person and it is perceived as appropriate. Instead, other studies indicated that successful negotiators express positive emotions. To reconcile this inconsistency, we propose that the direction of the effects of emotions depends on their perceived target, that is, whether the negotiators’ emotions are directed toward their opponent’s proposals or toward their own ‘exit (...) option’. An ultimatum game scenario experiment showed that negotiators who express positive emotion rather than negative, in addition to benefits in terms of relationship fortification, received better offers when participants perceived the negotiators’ emotions directed toward their own ‘exit option’. These findings indicate that positive emotions may signal the availability of better ‘exit option’, suggesting that happiness expressions can be strategically used to maximize both material and relational outcomes. ABSTRACTWhen in emotional distress, people often turn to others for social support. A general distinction has been made between two types of support that are differentially effective: Whereas socio-affective support temporarily alleviates emotional distress, cognitive support may contribute to better long-term recovery. In the current studies, we examine what type of support individuals seek. We first confirmed in a pilot study that these two types of support can be reliably distinguished. Then, in Study 1, we experimentally tested participants’ support evaluations (...) in response to different emotional situations using a vignette methodology. Findings showed that individuals perceived any type of reaction that included socio-affective support as preferable. The evaluation of cognitive support, however, was dependent on the specific emotion: Unlike worry and regret, anger and sadness were characterised by a strong dislike for purely cognitive support. Crying is a common response to emotional distress that elicits support from the environment. People may regulate another’s crying in several ways, such as by providing socio-affective support (e.g. comforting) or cognitive support (e.g. reappraisal), or by trying to emotionally disengage the other by suppression or distraction. We examined whether people adapt their interpersonal emotion regulation strategies to the situational context, by manipulating the regulatory demand of the situation in which someone is crying. Participants watched a video of a crying (...) man and provided support by recording a video message. We hypothesised that when immediate down-regulation was required (i.e. high regulatory demand), participants would provide lower levels of socio-affective and cognitive support, and instead distract the crying person or encourage them to suppress their emotions, compared to when there is no such urgency (i.e. low regulatory demand). As predicted, both self-reported and behavioural responses indicated that high (as compared to low) regulatory demand led to a reduction in socio-affective support provision, and a strong increase in suppression and distraction. Cognitive support provision, however, was unaffected by regulatory demand. When the context required more immediate down-regulation, participants thus employed more regulation strategies aimed at disengaging from the emotional experience. ABSTRACTOther people’s emotional reactions to a third person’s behaviour are potentially informative about what is appropriate within a given situation. We investigated whether and how observers’ inferences of such injunctive norms are shaped by expressions of anger and disgust. Building on the moral emotions literature, we hypothesised that angry and disgusted expressions produce relative differences in the strength of autonomy-based versus purity-based norm inferences. We report three studies using different types of stimuli to investigate how emotional reactions shape norms about (...) potential norm violations, and contexts. Although convergence in emotion expressions within small groups is well documented, the motives that explain why members converge are rarely explicated. We approach expressive convergence from a conformity perspective and introduce the Emotional Conformity Framework, in which we posit that members match their groupmates’ emotion expressions because they are motivated to gain an accurate understanding of reality (informational conformity motive) or to form and maintain social relationships (normative conformity motive). These motives determine members’ standards for correctness, social responses, and plausible (...) convergence mechanisms, while members’ personalities and situational properties shape the relative strength of the two motives. By explicating these motivational underpinnings, the Framework improves our capacity to understand, predict, and regulate expressive convergence and emphasizes its functionality. (shrink)

Phenomenology of practice is a useful, rigorous way of deeply understanding human phenomena. Therefore, it allows research to be conducted into nursing's most sensitive and decisive aspects. While it is a widely used research approach and methodology in nursing, it is seldom addressed and made use of in its practical and applied value. This article aimed to approach the global outlook of van Manen's hermeneutic‐phenomenological method to better understand its theoretical background and to address and support the contribution this (...) method can make to nursing, if rigorously applied. For a professional discipline like nursing, van Manen's approach is especially interesting because, in addition to contributing to the body of knowledge of nursing, it provides a special kind of knowledge that allows nurses to act in a more reflective manner, and with tact and skill, in certain situations and relationships that arise in their daily practice. A more in‐depth understanding of this research methodology may help nurse‐researchers make good use of it and also harness knowledge derived from this type of research. This comes as a result of assuming that phenomenological texts, the final product of the research, have tremendous educational potential for people who read them carefully. (shrink)

Since its inception, phenomenological philosophy has exerted an influence on empirical science. But what is the best way to practice, use and apply phenomenology in a non‐philosophical context? How deeply rooted in phenomenological philosophy must qualitative research be in order to qualify as phenomenological? How many of the core commitments of phenomenology must it accept? In the following contribution, I will take a closer look at Max van Manen's work. I will argue that van Manen's understanding of and (...) presentation of phenomenology is quite problematic and that his book Phenomenology of Practice rather than amounting to a clear and accessible presentation of the phenomenological method that would make it do‐able to researchers who are not themselves professional philosophers is in fact both abstruse and excessively complicated. I will then turn to nursing, and by taking that as my example, outline a better way to apply and practice phenomenology. (shrink)

Phenomenology as Qualitative Research: A Critical Analysis of Meaning Attribution has attracted the attention of Max van Manen, who has published a highly critical review article. Anyone reading this article, but unfamiliar with the book, will get a distorted view of what it is about, whom it is addressed to, what it tries to achieve, and how it goes about presenting its arguments. Not mildly distorted, in need of the odd correction here and there, but systematically misrepresented. One problem (...) is that van Manen appears to have an idée fixe which prevents him from recognizing that the book is not about a certain philosophical tradition (known as “phenomenology”), but about a particular type of qualitative research (also known, unfortunately and confusingly, as “phenomenology”). A second idée fixe disposes him to misread an earlier article of mine and (much more seriously) three works by Heidegger. My aim in this article is to describe these two idées fixes, and exhibit their consequences. In doing so, I will examine what van Manen has to say on four crucial topics: meaning, lived experience, empathy, and Heidegger's analysis of boredom in The Fundamental Concepts of Metaphysics. A partir del cuestionamiento de Dan Zahavi respecto de la idoneidad del enfoque fenomenológico empleado por Max van Manen, el artículo pretende mostrar que la obra de este reconocido investigador de origen holandés ofrece un acercamiento al sentido original de la fenomenología. En particular, se plantea que la crítica de Zahavi a la ausencia de alineación del proyecto de Van Manen con las fuentes de la tradición fenomenológica debe ser matizada. Así, en lo que respecta a las obras (...) del investigador holandés que son sometidas a examen crítico por Zahavi, se puede establecer una cercanía con el enfoque fenomenológico-existencial de Martin Heidegger. Para ello, se destacan, en primer lugar, los elementos centrales del carácter fenomenológico que se plasma en estas obras. En segundo lugar, se ofrece un breve acercamiento a las lecciones impartidas por Heidegger en el semestre de 1919-1920. En estas, se expresa un sentido de la investigación fenomenológica que se corresponde con el carácter existencial que puede identificarse en algunas de las obras del investigador holandés, y que mantiene una significativa vigencia en la práctica de la fenomenología como enfoque de la investigación cualitativa. Finalmente, se plantea que la crítica de Zahavi a Van Manen puede comprenderse no solo como el resultado de una preocupación por la idoneidad del enfoque fenomenológico en el contexto de la investigación cualitativa, sino, de modo más básico, que es la expresión de una tensión entre diferentes maneras de apropiarse del ejercicio fenomenológico.
